This Policy applies when you (“you” or “user”) visit our website at qmenu.us and qmenu360.com, use our mobile app, or use any of our services (collectively, “Sites”). When you provide us with any information, including Personal Information (as defined below), you consent to our collection, use, retention, and disclosure of your information in accordance with this Policy and as permitted by law. If there are any terms in this Policy that you do not agree with, please discontinue use of our Sites.

1. Personal Information We Collect

1.1 Personal Information

When you use our Site, we collect personal information that you voluntarily provide to us. This may include your first and last name, email address, mailing address, phone number, and other similar contact data. The Personal Information we collect depends on the context of your interactions with us and your use of the Sites. We do not collect Personal Information unless it is provided voluntarily. All Personal Information you provide us must be true, complete and accurate, and you must notify us of any changes to such personal information.

1.2 Payment Information

When placing an order through the Sites, you must submit payment information. In addition to Personal Information, you will be required to submit financial information, such as a credit card number, debit card number, Google Pay, Venmo, Paypal, or other financial account information (collectively “Payment Information”). If you complete an order through the Sites as a “Guest,” we do not create an account for you. The information you provide when completing an order is kept only for the purposes outlined in this Privacy Policy and Terms of Use.

1.3 Social Media Information

We provide you with the option to use your social media account, such as Facebook or Google, to place an order. If you engage with us this way, your social media account may share Personal Information with us. The Personal Information we receive varies depending on the social media provider, but will often include your name, e-mail address, contacts list, profile picture, and other information you choose to make public. Please note that we do not control, and are not responsible for, other uses of your Personal Information by your third-party social media provider. If you place an order using a social media login through the Sites, you may remove Qmenu’s access to your social media account information. This can be done through the settings of your social media account. Please note if you remove Qmenu’s access to your social media account, your social media account may retain certain information you provided to it. Qmenu is not responsible for the information retained by your social media account.

1.4 Geolocation Information

With your consent, we may obtain geolocation information from your mobile device, or certain third-party providers while you are using our Sites, to provide location-based services. You may control the collection of geolocation information based on your mobile device’s settings. If you decline to allow Qmenu to collect geolocation data, Qmenu may not be able to provide certain services to you..

1.5 Other Information

We collect other information you voluntarily provide us, such as your food orders, birthday, and favorite restaurants or foods.

1.6 Information Collected Automatically

We may automatically collect certain types of information when you use or visit our Sites. We use this information to improve and enhance our Sites, your experience, and for security purposes. This information does not reveal your Personal Information. It may include: 1) the device and usage information you use to access the Sites; 2) your IP address; 3) browser and device characteristics 4) operating system 5) referring URLs, 6) your location, and 7) what parts of the Site you use and how often. If you use your mobile device to use the Sites, we may automatically collect device information (such as your mobile device ID, model and manufacturer), operating system, version information, and IP address. Your privacy is important to us. Qmenu, however, does respond to or act when we receive a Do No Track signal from your browser.

  2. Fulfill your requests and process payments (e.g., to allow you to order food from Restaurants and have it delivered to you, or to provide you with information that you request).
  3. Provide custom, personalized content and information (e.g. “your previous orders”)
  4. Perform analytics, detect activity patterns on our Platform and Services, and otherwise research usage
2.2 Maintain the safety, stability and security of our Platform and Services.

We may use the personal information to maintain the safety and security of our Platform and Services. For example, we:

  1. Detect or prevent fraud, abuse or other harmful activities
  2. Diagnose or fix technology problems

3. Our Sharing and Disclosure of Personal Information

3.1 Restaurant Sharing.

We disclose personal information to the Restaurants you order from and third parties engaged by those Restaurants (e.g. point of sale providers or their own delivery personnel), as needed to fulfill your orders, including communicating with you about the status of your order or cancelled items. If you make a purchase from a Restaurant that offers loyalty or rewards programs through our Platform, we may disclose your personal information to the Restaurant as needed to facilitate your participation in the Restaurant’s loyalty or rewards programs, including to track points and redemptions. In some cases, you may also affirmatively opt in to share your information directly with the Restaurant as will be disclosed on the Platform.

3.2 Other Third Parties necessary to complete your order or to enable your use of the Platform and Services.

In addition to Restaurants you order from, we disclose personal information to other third parties as needed to fulfill your orders, including, without limitation, delivery providers and payment processors.

3.3 Legal Obligations and Rights.

We disclose personal information to third parties, such as legal advisors and law enforcement, as required by law or subpoena or if we reasonably believe that such action is necessary to (a) comply with the law and the reasonable requests of law enforcement; (b) enforce our Terms of Use or to protect the security or integrity of our Services; (c) detect, suppress or prevent fraud or reduce credit risk and collect debts owed to us; and/or (d) exercise or protect the rights, property, or personal safety of Qmenu, our visitors, or others.

4.1 Profile Settings.

You may update your profile information in the “Your Account” section of the Services.

4.2 Access to your Device Information and Push Notifications.

You may control access to your device information or opt out of push notifications through your “Settings” app on your device. For instance, you can withdraw permission for the app to access your location data through your device settings, though we may continue to approximate your location based on your IP address or through other means.

5. How We Store and Protect Your Information

Keeping your information safe.

We care about the security of your information and employ physical, administrative, and technological safeguards designed to preserve the integrity and security of all information collected through our Service. However, no security system is impenetrable and we cannot guarantee the security of our systems. Please recognize that protecting your personal information is also your responsibility. Accordingly, we strongly recommend that you change your passwords often, use a combination of letters and numbers, make sure you use a secure browser, and otherwise take precautions when communicating your personal information on the internet. 6. Children’s Personal Information

Keeping your information safe.

Our websites and online Services are not directed to, and we do not intend to, or knowingly, collect or solicit personal information from children under the age of 13. In the event that we learn that we have inadvertently collected personal information from a child under age 13, we will delete that information as quickly as possible. We will update this Privacy Policy from time to time. When we make changes to this Privacy Policy, we will change the "Effective" date at the beginning of this Privacy Policy. If we make material changes to this Privacy Policy, we will notify you by email to your registered email address, by prominent posting on this website or our online Services, or through other appropriate communication channels. All changes shall be effective from the date of publication unless otherwise provided. If you do not cancel your Account before the date the revised Privacy Policy becomes effective, your continued access to or use of the Platform and/or Services will be subject to the revised Privacy Policy.
